Beyond Borders: COVID-19 Highlights the Potential Widespread Impact of the Illinois Biometric Information Privacy Act

Chicago Partner Rusty Perdew, Co-Chair of Locke Lord’s Consumer Products, Retail & Franchise Industry Group and member of Locke Lord’s Class Actions Practice Group, co-authored an article with Dallas Associates Taylor Levesque and Brandan Montminy for Privacy & Cybersecurity Law Report discussing the potential for an increase in claims under the Illinois Biometric Information Privacy Act (BIPA) based on businesses’ new remote operations and procedures in response to the COVID-19 pandemic.

The article discusses how the recent shift to remote work and e-learning has increased related businesses’ exposure to privacy regulations, including BIPA. Because of the rush to go remote, employers “may not have considered the legal risks associated with data collection and analytics as thoroughly as they would have under normal circumstances,” the authors note.
