New York Partner Richard Reibstein Quoted by Law360 on Independent Contractor Issues Beyond Proposition 22

Richard Reibstein, co-head of Locke Lord’s Independent Contractor Compliance and Misclassification Practice, was quoted by Law360 on a recent ruling concerning California’s Proposition 22.  Richard noted that, although the decision reinstated the results of the voting initiative, which supports an independent contractor relationship between drivers and Uber, Lyft and other app-based companies, the decision does not resolve lingering questions and concerns affecting the status of the overwhelming number of independent contractors in California who are not covered by Prop 22.

“Prop. 22 affects a very small sector of the independent contractor population,” Reibstein said. “Well over 90% of independent contractors are not driving for Uber or Lyft or providing services for Instacart. They’re the entrepreneurs who have their own businesses and are upset with, and have been upset with, A.B. 5 and Dynamex for years.”
