Richard Reibstein, co-head of Locke Lord’s Independent Contractor Misclassification and Compliance Practice, was quoted by Law360 regarding New Jersey Supreme Court’s plans to review the question of whether exemptions from the ABC test for independent contractors under the state's Unemployment Compensation Law apply to determinations of worker status under that state’s wage laws, which borrowed the same ABC test for independent contractor status in a 2015 decision by that court.
Reibstein explained that clarification from the New Jersey Supreme Court is "absolutely critical for those industries that have an exemption under the unemployment law."
