New York's Richard Reibstein Quoted by Law360 on Challenges Implementing a Federal Independent Contractor Test

Richard Reibstein, co-head of Locke Lord’s Independent Contractor Misclassification and Compliance Practice, was quoted by Law360 on the likelihood of the implementation of a federal ABC test for independent contractor status similar to the one previously enacted in California. Reibstein noted a federal ABC test is unlikely to materialize because the California law containing the test has faced significant legal challenges.

"It's a lost cause," Reibstein said. "No one is eager to copy California, because of the tremendous backlash that effort in that state has created."
