Richard Reibstein, Co-Head of Locke Lord’s Independent Contractor Misclassification and Compliance Practice, was quoted by Law360 on the opposition to establish a federal standard modeled on an ABC test for independent contractor status. He noted a study by the U.S. Government Accountability Office and the DOL's Bureau of Labor Statistics indicating that a large majority of independent contractors are satisfied with their status.
"These are workers who are extremely dismayed by laws such as A.B. 5 or its counterpart in Massachusetts," Reibstein said. "Most workers across the country would likely feel the same way if there was a federal ABC test like in Massachusetts and California."
