Richard Reibstein, a Partner in Locke Lord’s Labor and Employment Practice in New York and co-head of the Firm’s Independent Contractor Misclassification and Compliance Practice, was quoted in a Gartner Journal of Finance. Risk. Strategy. (Fi.r.st) article on the risks to businesses of independent contractor misclassification.
Reibstein suggests steps for businesses to take to achieve compliance with labor laws, including modifying the structure, documentation and implementation of contractual relationships and training managers on tactics to communicate with contractors. He also notes using contractors who are employees of a staffing firm minimizes risk, “but it’s going to be more costly.”
