Richard Reibstein, a Partner in the Firm’s Labor and Employment Practice in New York and Co-Chair of Locke Lord’s Independent Contractor Misclassification and Compliance Practice, was quoted in an article regarding the U.S. Department of Labor’s updated guidance that will be used when investigating home care registries to determine whether they are directly employing workers. Reibstein said, “The bulletin states that a registry’s decision to terminate a caregiver ‘for failing to comply with the requirements and standards established by the industry, the client, or the law’ indicates that the registry is an employer of the caregiver. This view is contrary to many court decisions under the FLSA involving a variety of industries.”
