David Gregory, Chris Dove and Ed Razim (All of Houston) represented Waste Connections and secured a 5th Circuit decision that upheld a trial court's finding that the client did not owe a former accountant nearly $250,000 in severance pay or shares in its equity incentive plans because he was fired for just cause. The court found that Waste Connections’ plan administrator had not abused her discretion and had substantial facts, including missed important deadlines, and had not made an arbitrary decision.
