Richard Reibstein and Janet Barsky (both of New York) secured two decisions in favor of their client from the California Employment Development Department (EDD) on the issue of independent contractor classification. The first was in favor of a nationwide travel management services company, where EDD found that travel agents in its network of independent travel agencies are to be classified as independent contractors and not employees. The second EDD decision was in favor of a nationwide tutoring referral company, where EDD found that tutors who the company referred to its clients were independent contractors and not employees. Reibstein and Barsky also secured from the New York State Department of Labor an additional favorable decision for the latter client, noting that tutors in New York who were referred to customers are likewise independent contractors and not employees under that state’s unemployment insurance law.
