Emma Doineau focuses her practice in business litigation and dispute resolution. She has assisted both plaintiffs and defendants in the public and private sectors with resolving disputes covering a broad range of legal issues, including breach of contract, fraud, Lanham Act violations, Foreign Corrupt Practices Act violations, trademark infringement, insurance and indemnity disputes, trade secret misappropriation and unfair competition. Her experience spans every stage of dispute resolution from initial investigations through trial or arbitration and appeal.

Emma is also deeply committed to pro bono service and is serving as a member of the Board of Directors of the Houston Bar Association’s Houston Volunteer Lawyers for the 2020-2022 term.

  • Represented international commodity seller in pursuing claims against competitor, defeating motions to dismiss and obtaining resolution prior to close of discovery
  • Second-chaired bench trial on behalf of prominent, national elevator company in dispute involving claims of breach of contract and fraud
  • Defended international savory café franchisor against claims from multinational confectionary brand licensor relating to Middle East franchises in ICC Arbitration that, following a final hearing, resulted in three-member Tribunal awarding claimant zero damages and fees
  • Represented midstream company plaintiff in dispute arising from natural gas gathering and processing contract, leading to settlement with defendant after presentation of case in chief during first week of scheduled two-week jury trial
  • Defended tenant on a pro bono basis against CARES Act violations in eviction proceedings, resulting in judgment for defendant
  • Represented individual taxpayer on a pro bono basis in tax refund action against IRS involving claims of erroneous assessment and collection of federal income taxes, penalties and interest, leading to pre-trial settlement and recovery of over $230,000 of client’s assets
  • Represented prominent athletic supply retailer in dispute against international garment vendor over breach of contract claims and secured international judicial assistance to recover key evidence after which all claims were settled
  • Represented political subdivision of the State of Texas in dispute against private corporation relating to ownership of real and personal property used in the provision of fire suppression, rescue and emergency medical services and obtained relief for client on summary judgment
  • Represented global engineering, procurement, fabrication, construction and maintenance company in pursuit of insurance and indemnity claims against subcontractor, leading to eve-of-trial settlement 
  • Represented insurance company in duty-to-defend coverage dispute that was resolved on behalf of client at the summary judgment phase
  • Defended EPC contractor against claims relating to design, fabrication and commissioning of natural gas processing plant in Colorado
  • Represented water and environmental services provider in AAA arbitration proceedings relating to dispute over indemnification for state tax audit liability
  • Defended several related entities against claims of trade secret misappropriation and unfair competition based on licensed trade secret rights and proprietary processes used in the creation and sale of sulfur dioxide
  • Represented EPC contractor in breach of contract dispute against owner of gas processing plant in Colorado
  • Defended private school against breach of contract and fraud claims in dispute with lessor
  • Defended downhole technology company against claims of fraud related to a multimillion-dollar stock purchase transaction in AAA arbitration
