Texas Team Secures Ruling Allowing Irving Firemen's Relief & Retirement Fund to Make Changes to Pension Plans

On March 8, the Supreme Court of Texas sided with the Irving Firemen’s Relief & Retirement Fund’s interest in a case that will affect all pension plans across Texas that are sponsored by state and local government entities. Locke Lord’s Kent Hofmann and Susan Kidwell (both of Austin) represented Irving Firemen's Relief & Retirement Fund — preparing and submitting an Amicus Curiae Brief in support of respondent Dallas Police and Fire Pension System in an appeal brought by former Dallas police officers. The Dallas police officers sought to invalidate prospective changes to the City’s pension plan, relying on a Texas constitutional amendment that they alleged prohibited such changes. The Supreme Court of Texas sided with the pension system, and the decision enables certain pension plans in Texas, including the Irving Firemen's Relief & Retirement Fund, to continue to make prospective changes to their plans.
