Locke Lord Represents DaVita Healthcare Partners in Declined Class Certification

A Locke Lord team led by Lisa Ruggiero prevailed on behalf of client DaVita Healthcare Partners when a federal judge in Colorado declined to certify a class of patients who claimed to have been injured from the use of certain dialysis products at DaVita clinics. After months of discovery, extensive briefing and a two-day class certification hearing, the Judge denied the plaintiffs’ motion seeking class certification, stating that individual issues were “so central” to the plaintiffs' claims that certifying a class of as many as 300,000 members "would not achieve significant economies of time, effort and expense."
