Chair of Locke Lord’s Renewable Energy Section and Houston Environmental Partner Ben Cowan was quoted by E&E News Greenwire on the uncertainty surrounding what rules are currently governing the permitting process around wetlands and waterways after the U.S. Supreme Court’s decision in Sackett v. Environmental Protection Agency (EPA).

“The practical implications of the decision are that federal Clean Water Act permits will no longer be required in many, if not most, situations where they previously were required,” said Cowan. “This will remove one obstacle to project development and, as importantly, will provide much greater clarity as to whether or not a project will require a permit.”
