Ben Cowan, a Partner in the Firm’s Environmental Section, addressed the potential loss of the NWP-12 permit in an Argus Media article noting that it is a "hugely significant" decision for industry as pipeline companies, wind farms and other developers could be subject to more time-consuming permitting procedures. Another option, he noted, would be to avoid needing a permit, such as using costly horizontal drilling technology to cross below streams and other waterways. For some projects it could be days or weeks of delay if they can find a suitable alternative pathway, Cowan said. "For other projects it could be months or a year or more."
