Scott Hastings, a Partner in Locke Lord’s Dallas office and member of the Firm’s Appellate Practice Group, was quoted in a Bloomberg Law article on the oral arguments before the U.S. Supreme Court in Allen v. Cooper and the significance of the copyright issues the justices will consider for the first time.
Hastings noted the case is “filled with constitutional issues that haven’t been addressed before,” including the relationship between states’ sovereign immunity and copyright.
The case concerns whether the State of North Carolina has sovereign immunity from a copyright infringement lawsuit brought by a videographer who captured footage of the shipwreck of Blackbeard’s pirate ship, the Queen Anne’s Revenge. Hastings wrote an amicus brief in the case on behalf of a group of scholars supporting the videographer, who claims the state used his video without consent.
