Michael Renetzky, Co-Chair of Locke Lord’s Corporate and Transactional Department, Chair of the Firm’s Finance Committee and Managing Partner of its Chicago office, commented on the U.S. Court of Appeals for the Fifth Circuit’s split decision on the DOL’s fiduciary rule, saying he thinks it’s not over yet. Renetzky imagines the case will be heard en banc, by all of the judges in the fifth circuit, especially given the 2-1 vote. He added that much later, a U.S. Supreme Court decision could ultimately decide the rule’s fate.
