In a May 13, 2015 Law360 article focusing on how companies and businesses are facing increased pressure from DOJ and other regulatory agencies to report data breaches, Locke Lord Hartford Partner Ted Augustinos noted that “Regulators and law enforcement can, in fact, assist with investigations, potentially saving significant cost for the entity suspecting it may have suffered a breach. On the other hand, involving a regulatory or law enforcement authority in an investigation can come at a cost.” Notifying regulators at the earliest possible stage of the incident can also help companies save time and resources and shed new light on the attack based on other incidents that the agencies may have dealt with in the past, Augustinos added.
