BACKGROUND
In 2013, Mexico passed a Constitutional Reform, liberalizing the country’s energy industry and putting an end to decades of government monopoly over the power, oil and gas sectors. In recent years, some policies and regulations seem to have been adopted (or sought to be adopted) with the goal of repealing or modifying key components of the 2013 Reform. These measures – collectively known as the “counter-reform,” would significantly impact the economics of energy projects undertaken by private investors.

ANTECEDENTES
En el 2013, México adoptó una reforma constitucional dirigida a liberalizar la industria energética nacional y a poner fin a décadas de monopolio estatal en el sector. Desde inicios del 2020, se han implementado (o tratado de implementar) varias medidas con el fin de modificar disposiciones clave de la Reforma del 2013. Dichas medidas – que en su conjunto forman la “Contrarreforma” – representarían un impacto significativo a los aspectos económicos de los proyectos liderados por inversionistas del sector privado.
