Jennifer Capasso Mendonça spoke at the Boston Bar Association's CLE, Nonprofits and Solar Power, on January 22, 2020.
For-profits and individuals are encouraged to use solar power through solar power tax incentives, which are of little use to nonprofits. What does the solar power marketplace look like for nonprofits? This course explained the legal and business structures that have developed to allow nonprofits to benefit from solar power initiatives. Sample nonprofit solar power projects were described from both a legal and business perspective. The potential tax pitfalls that nonprofits must avoid when undertaking a solar power project, including unrelated business income tax, real estate tax exemption, and the private business use of tax exempt bond-financed property were also discussed.
