Locke Lord Secures Appellate Decision in Favor of Iowa Wireless Services in Breach of Contract Case

Susan Kidwell (Austin) and Tom Loose (Dallas) secured an appellate decision in favor of Iowa Wireless Services (IWS), as the Fifth Circuit unanimously reversed the district court’s order denying IWS’s claim for over $2.5 million in attorneys’ fees under the Texas Theft Liability Act, reversed the district court’s award of over $2 million in attorneys’ fees to Transverse on its claim for breach of the parties’ Supply Contract and affirmed the district court’s denial of fees to Transverse under its claim for the breach of the parties’ Non-Disclosure Agreement. The case has been remanded back to the district court to determine the proper amount of attorneys’ fees to be awarded to IWS.
