Chicago Team Secures Decision in Favor of Adkins Energy in Patent Case

A Locke Lord Chicago team led by Keith Parr including James Peterka, Wasim Bleibel and Hugh Balsam (Appeals) secured a final ruling in favor of Adkins Energy LLC, as the U.S. Supreme Court denied a petition filed by GS CleanTech Corp. seeking review of a Federal Circuit decision affirming, among other lower court rulings, that CleanTech’s asserted patents were unenforceable due to inequitable conduct before the U.S. Patent Office. The Federal Circuit decides very few inequitable conduct cases, and final Supreme Court review is sought in even fewer cases. Parr noted, "We are pleased that the Supreme Court has declined review of this case. This order appropriately ends a litigation agenda that should never have been initiated."
