New York Duo Represents Mazars USA in Dismissal of Insurance Trust Lawsuit
Ira Greenberg (New York) represented Mazars USA LLP in the dismissal of a lawsuit brought against Mazars and one of its partners over an insurance trust of which the partner was a trustee. The successor trustees’ claim of breach of fiduciary duty was dismissed by the New York Supreme Court on statute of limitations grounds, while their claim of aiding and abetting fraud was dismissed for lack of an actionable fraud claim against any other person, or failure to state cause of action. The decision was affirmed in a unanimous decision by the Appellate Division of the court on May 28, 2020.
