Cesar Escalante

Cesar Escalante concentrates his practice on labor & employment law. He has significant experience representing employers on various employment issues, including discrimination, retaliation, harassment, covenants not to compete, misappropriation of trade secrets and breach of employment agreements and contracts. He also has assisted employers in drafting company policies, procedures and agreements covering several subject areas, including employment contracts, separation agreements and employee handbooks.

Cesar’s experience includes:

• Obtained trial ruling as second chair on wage & hour case where jury found fluctuating workweek method applied and plaintiff failed to show employer willfully violated FLSA
• Obtained summary judgment on complex real estate dispute involving claims of breach of contract, money had and received, common law fraud, fraud by non-disclosure and breach of fiduciary duty
• Prepared and presented harassment prevention trainings in English and Spanish covering subjects including, equal employment opportunity compliance, sexual harassment, discrimination and retaliation 
• Drafted policies for employee handbooks covering subjects including benefits, compensation, discrimination, hiring, leaves of absence, payroll requirements, vacation and paid time off, personnel files, employee privacy, and workplace rules and employee conduct
