Locke Lord's Privacy & Cybersecurity Group has a dedicated team of lawyers with industry-specific experience who utilize an interdisciplinary approach to help clients navigate cyber insurance matters.
The team partners with global insurance clients to consider policy wording and potential cyber exposures under stand-alone cyber policies or endorsements, as well as under a variety of first-party and third-party policies such as property, CGL, D&O, E&O, fidelity, and EPL. The team's experience includes product development, risk management, and coverage work involving claims analysis, claims monitoring, litigation, mediation and arbitration. In addition, team members are selected or approved by insurers to advise insureds in breach response and other data security incidents, and to defend insureds in litigation and other legal and regulatory proceedings.
Coverage issues in this quickly evolving arena include new issues arising from ever developing technologies and new or changing regulatory and statutory developments, as well as those often seen with many other kinds of risks. The team has keen insight into how different jurisdictions have ruled or may rule on coverage issues affecting cyber insurers. This comes from the team's familiarity with cyber exposures, its experience with cyber wordings and risks as well as many other types of policies and claims, and its participation in the Firm’s Privacy & Cybersecurity Group.
