Andrea Verney Kerstein

Andrea Verney Kerstein is a member of the Firm’s Board of Directors, Managing Partner of the Firm’s Chicago office and Chair of the Firm’s Health & Managed Care Litigation Practice Group. She has significant experience representing insurers and reinsurers in insurance and health care disputes and arbitrations, primarily in the life insurance and health insurance lines. Andrea also has experience representing both local and international plaintiffs and defendants in other complex commercial litigation and arbitration matters.

Insurance & Health Care Practice

• Counsel for national health insurance company before state insurance departments and government agencies to obtain approvals for $17.3 billion transaction
• Regularly represents health insurance companies in provider disputes brought in both arbitration and litigation, arising out of alleged breach of contract, fraud and a variety of other disputes
• Frequently represents life reinsurance companies in disputes regarding reinsurance treaty issues
• Obtained a panel order granting reformation of a life reinsurance treaty and damages for breach of contract

Complex Commercial Matters

• Served as lead counsel on behalf of defendant in fraudulent transfer action; obtained summary judgment for the defendant
• Obtained verdict as second chair in bench trial representing plaintiff industrial services company in breach of warranty matter
• Represented a platform owner in litigation with the owner of a vessel that allided with the platform
• Represented academic institutions as plaintiff in breach of royalty agreement claims
• Assisted in obtaining a multimillion-dollar pre-trial settlement as plaintiff in lawsuit in a horizontal drilling products liability matter
• Represents association defendant in lawsuit claiming various business torts; obtained dismissal for lack of personal jurisdiction in original forum
• Defended marketer of oil and gas assets against multimillion-dollar counterclaims; case settled before trial with payment made to marketer
• Represented UK-based well service provider in breach of warranty case
• Assisted in obtaining confirmation of arbitration award for a marine service company
• Obtained settlement in AAA arbitration against exploration and drilling company in construction-based breach of contract matter
