Brian represents clients in a variety of restructuring matters, including Chapter 11 bankruptcy proceedings and out of court workouts. He represents debtors in reorganizations and liquidations, and has also built a robust practice representing creditors, landlords, and other stakeholders in distressed scenarios. Most recently, he has represented the largest general unsecured creditor in the Chapter 11 bankruptcy cases of Sears Holdings Corporation and its affiliates.
As part of his restructuring practice, Brian advises clients on litigation strategies, leases, and settlement agreements. This area of his practice involves designing and negotiating agreements that minimize clients’ exposure to distressed scenarios by providing clients with enhanced creditor, lessor, and settling party protections.
Brian’s restructuring experience is complemented by a corporate practice that focuses on dispute resolution among corporate executives, lending structures, and advice on various types of contemplated investments.
