Matt's experience includes:

Antitrust Litigation
  • Representing large European bank in numerous class actions involving alleged manipulation of U.S. Dollar LIBOR and other interest rate and financial derivative benchmarks (EURIBOR, YEN LIBOR, ISDAFIX)
  • Representing large European bank in numerous class and individual actions involving alleged manipulation of foreign exchange (FX) benchmarks
Securities Litigation
  • Represented issuers of residential mortgage-backed securities (RMBS) in multiple litigation matters brought by National Credit Union Administration Board (NCUA) as Conservator for several failed credit unions alleging fraud and violations of state and federal securities laws
  • Represented issuers of RMBS in multiple litigation matters brought by various Federal Home Loan Banks alleging fraud and violations of state and federal securities laws
False Claims/Qui Tam Litigation and Investigations
  • Represented mortgage lenders/servicers in qui tam litigation alleging false statements to government-sponsored entities (GSEs) to recoup expenses not recoverable under applicable guidelines and contracts
  • Represented mortgage lenders/servicers in qui tam litigation alleging financial institutions made false statements to avoid payment of fees for recording security instruments
Consumer Class Action Litigation

Matt has represented banks and other lenders, servicers, securitized trusts and others in dozens of class actions involving claims under the Truth in Lending Act (TILA), Real Estate Settlement Procedures Act (RESPA), Fair Credit Reporting Act (FCRA), Fair Debt Collection Practices Act (FDCPA), Equal Credit Opportunity Act (ECOA), Telephone Consumer Protection Act (TCPA), Homeowners Protection Act (HPA) and state consumer fraud/deceptive business practices statutes, such as California Business & Professions Code §§ 17200, et seq. (UCL), and the Bankruptcy Code.

  • Representing student loan trusts in putative class actions seeking classwide discharge of certain categories of student loans on various grounds
  • Representing student loan trusts in putative class actions alleging improper collection and litigation tactics
  • Represented various banks and mortgage servicers in class actions alleging defects in private mortgage insurance (PMI) disclosures and general mortgage insurance (MI) cancellation procedures
  • Represented mortgage lenders/servicers in several class actions alleging improper loan payoff and recordation fees
  • Represented mortgage lender/servicer in class action alleging systemic service defects in foreclosure proceedings
  • Represented mortgage lenders/servicers in series of putative class actions alleging improper fees in association with Chapter 13 bankruptcy proceedings
  • Represented mortgage lender/servicer in putative class action alleging violations of state unfair competition laws, fraud and violations of RESPA in its use of seller-reserve auctions to liquidate foreclosed and other REO properties
