Locke Lord client LovelySkin successfully appealed an adverse result in a trademark case to the 8th Circuit. LovelySkin is one of the world’s largest internet retailers of cosmeceuticals, which are high-end cosmetics with pharmaceutical-grade ingredients. It filed a trademark infringement suit against a competitor, alleging the competitor was using a deceptively similar trademark for a similar business. After a District Court entered a judgment against LovelySkin on the grounds that LovelySkin’s trademark registrations for LovelySkin and LovelySkin.com were invalid, the retailer retained Locke Lord to handle post-trial motions and an appeal. On appeal, the 8th Circuit reversed the District Court's judgment that LovelySkin's trademark registrations were invalid.
