Atlanta’s Brian Casey and Tom Sherman co-authored a Law360 article examining significant life settlements market developments in 2020. The duo explores several new life settlement policy investment fund formations, life insurance litigation, noncontroversial legislative developments and an uptick in life settlement activity partially spurred by the COVID-19 pandemic.
Looking forward to 2021, Casey and Sherman predict continued strong growth in retained death benefit life settlement transactions, potential targeted audits from the IRS if confusion remains regarding proper reporting of investment acquisitions of life insurance policies and payment of death benefits and possible changes to regulations, including tax regulations, that might impact the life settlement industry with a change of administration in Washington.
