Locke Lord Dallas Associate Mario H. Nguyen, a member of the Firm’s White Collar Criminal Defense & Internal Investigations Practice Group, authored an article on United States v. Miller. According to Nguyen, escaping certain sentencing enhancements with white collar defendants is an uphill battle, and the defendant convicted of bank fraud in United States v. Miller is no exception. Still, the Fifth Circuit’s opinion clarifies some legal standards and provides insight into the application of these enhancements.
