Dallas Partner Brad Weber, Co-Chair of Locke Lord’s Antitrust Practice Group and Artificial Intelligence Industry Group, was quoted by The Associated Press on Washington state’s antitrust lawsuit to block the proposed merger of Kroger and Albertsons as well as its implications on separate lawsuits from Colorado and the Federal Trade Commission (FTC), which also seek to block the merger on the grounds that it would negatively impact industry competition nationwide. Weber comments on the possible outcomes of the case, noting that the Washington Superior Court judge could require Kroger to divest grocery stores in Washington or even “halt the merger nationwide.”
“[Judge] Ferguson may also decide to delay [a ruling in] the case until there’s a ruling from the U.S. District Court in Oregon,” Weber says. “In that case, the Federal Trade Commission has asked a judge to temporarily block the merger until it is considered by an in-house judge at the FTC.”
