Dallas Partner and Litigation Department Co-Chair John McDonald Quoted From Closing Arguments in Law360 Article Highlighting Locke Lord’s Representation of Henry Schein Inc.

John McDonald, Co-Chair of Locke Lord’s Litigation Department and a Partner in the Firm’s Dallas office, was quoted from his closing arguments in a Law360 article highlighting the Firm’s representation of Henry Schein, Inc. McDonald is defending Henry Schein against claims that the dental supplier, along with Benco Dental Supply Corp. and Patterson Cos., colluded against buying groups to negotiate lower prices. McDonald argued against the FTC’s claims that communications between the dental supplier executives pointed towards a conspiracy. In reference to the FTC’s lack of evidence, McDonald said, “They want to cherry-pick a few rocks, but they ignore the mountain of evidence.”

According to McDonald, Henry Schein actually put considerable energy and effort, with approximately $30 million in business, into working with buying groups “before, during and after this alleged conspiracy.”
