    Bill Primps Comments on Overtime Pay Dispute for Mortgage Underwriters in Law360

    New York Partner Bill Primps and Austin Partner Susan Kidwell are representing the American Bankers Association, Mortgage Bankers Association, California Bankers Association and California Mortgage Bankers Association. The Locke Lord team filed an amicus brief urging that the U.S. Supreme Court reject a Ninth Circuit decision finding mortgage underwriters were entitled to overtime, saying the conclusion departs from the long-standing application of U.S. Department of Labor rules.

    Primps told Law360 that the clients behind the ABA's amicus brief represent a "broad swath" of the financial services industry. He continued: "There is great concern about the uncertainty imposed on our operations by the existing circuit split among the 9th, 2nd and 6th Circuits, where more than a third of all U.S. mortgage applications are generated."
