Bombardier Recreational Products Obtains Partial Summary Judgment of Infringement In Snowmobile Patent Suit Against Arctic Cat

    News Release

January 26, 2017 – The Honorable John R. Tunheim, Chief Judge of the U.S. District Court in Minnesota, entered an Order Dec. 28, 2016, granting Bombardier Recreational Products ("BRP") summary judgment that each of Arctic Cat Inc.'s ("Artic Cat") 94 accused snowmobile models infringed BRP's U.S. Patent 7,124,847. The ruling was part of a long-running patent infringement suit by BRP against Arctic Cat. The Order was originally filed under seal and is now publicly available.

At the same time, the Court denied Arctic Cat's motions for summary judgment that the '847 and BRP's other asserted patents are invalid, leaving Arctic Cat's invalidity defenses, as well as BRP's claims for infringement of the other asserted patents, damages and willful infringement to be decided at trial.

No trial date has been set.

The Court's Order is available here.

BRP is represented by Harry Marcus, Robert Goethals and Joseph Farco of Locke Lord LLP and Kevin Conneely and Ruth Rivard of Stinson Leonard Street LLP.
