," O'Neil said, "As a litigator, I often meet with corporations or individuals contemplating or facing expensive court proceedings. The most important question to ask a prospective client is, 'What would you like to happen?'" According to Young, "I ask every client: 'How do you define victory in this matter? What are the legal, business and political objectives you seek to accomplish? In what order of priority do you place them?' It is certainly possible to win the case and lose the client. But it is also possible to lose the case and still fulfill important legal and business objectives of the client (defense of a product or position, reduction of potential damages and the like)."
