    Rick Miller, a public finance partner in Edwards Wildman's South Florida offices, discussed how municipal underwriters began facing heightened penalties for failing to comply with the U.S. Securities and Exchange Commission’s enforcement initiative around their disclosure obligations in Law360. In the article, “SEC's Muni Disclosure Rules Kick In For Underwriters," Miller said, “There’s a dilemma here. If the underwriters report an issuer they feel has been remiss in meeting its continuing disclosure undertaking obligations, the investment bankers will ... have to pay a penalty, although there’s a cap.”
