John McDonald has over 35 years of complex litigation and trial experience at a national level on a wide range of issues with a particular focus on cases involving federal and state governments, including pharmaceutical False Claims Act and qui tam litigation and government investigations regarding alleged antitrust violations as well as pharmaceutical pricing, marketing, promotion and regulatory issues.

His experience includes:

  • National counsel for a distributor in litigation across the United States stemming from the impacts of the opioid crisis
  • Represent pharmaceutical companies (brand and generic) in Medicaid fraud claims investigations and litigation brought by the United States and State Attorney Generals in state and federal court cases throughout the United States
  • Represent branded pharmaceutical company in Medicaid fraud claim brought by the Texas Attorney General alleging misbranding, illegal kickbacks and off-label promotion
  • Represent branded pharmaceutical company in qui tam suits under the False Claims Act alleging off-label promotion and illegal kickbacks
  • Represent laboratory in Civil Investigative Demand discovery initiated by the United States related to alleged Medicare fraud

His broad litigation and trial experience also includes general business litigation, antitrust litigation, environmental litigation, intellectual property litigation, lender liability, products liability and landlord/tenant litigation.

  • Represent distributor in a multi-week trial before the Federal Trade Commission
  • Represent international companies in antitrust in Civil Investigative Demand discovery initiated by State Attorneys General
  • Represent national banks in lender liability actions pending in state court, Federal District Court and Bankruptcy Adversary proceedings
  • Represent construction auditor in Federal District Court in case alleging breach of contract, defamation, tortuous interference and violations of the Lanham Act
  • Represent property owners in dispute regarding the constitutionality of taxes imposed by local flood control district
  • Represent the manufacturer of industrial equipment in a products liability action involving the severance of the injured party's legs
  • Represent escrow agent/attorney in alleged securities fraud and legal malpractice action

He has tried cases in both State and Federal Courts throughout the United States. He also provides service for clients through Alternative Dispute Resolution, including mediation and arbitration.
