March 24, 2014 - Locke Lord's representation of Retractable Technologies, Inc. in its $113 million jury verdict against rival syringe manufacturer Becton Dickinson & Company has been listed No. 17 in the National Law Journal's Top 100 Verdicts of 2013.
Published today, this list ranks cases based on the amount of the jury verdict award.
In Retractable Technologies Inc., et al. v. Becton Dickinson and Co., Dallas Partner Roy Hardin led a team of Locke Lord lawyers representing Retractable Technologies – a Texas-based manufacturer of safety medical devices – in an antitrust and false advertising suit against rival syringe manufacturer Becton Dickinson and Co.
Issued in September, the verdict vindicated Retractable Technologies' claim that Becton Dickinson illegally engaged in anticompetitive conduct with the intent to acquire or maintain a monopoly power in the safety syringe market, and engaged in false advertising under the Lanham Act. The initial $113 million jury verdict is subject to trebling under applicable antitrust law.
Though the monetary award was welcome, Hardin notes that the main focal point for his clients was the safety of health care providers. According to statistics from the U.S. Centers for Disease Control and Prevention, health care workers suffer about 800,000 accidental needlestick injuries every year in the United States.
“These are the types of incidents Retractable Technologies' products are designed to protect against,” said Hardin, who was recognized as Litigator of the Week by Texas Lawyer for his work on the case. “The ruling will make it easier for Retractable to get more of its patented safety syringes to consumers.”
