The article, "'Nightmare' Ruling On Software Patent Standard Baffles Attys," stated how the court didn't articulate a consistent standard, so now whether or not a software invention is deemed patent-eligible will depend on which judges hear the case, with the result boiling down to "the luck of the draw," according to Schechter. "It's a complete nightmare. There's no predictability at all," Schechter said.
