Is 'Tiffany Setting' a Generic Term? Edwards Wildman's David Weild Comments in JCK

    News
David Weild, a partner in Edwards Wildman's Intellectual Property practice in New York, discussed whether "Tiffany setting" is a generic term in JCK. In the article, "Is ‘Tiffany Setting’ a Generic Term?", Weild said, "The question will be, because something has a Tiffany setting, do you think it's a ring or diamond from Tiffany?" Furthermore, Weild added, "Tiffany has to ask: Is this case sufficiently important to put its trademark at risk? It never helps to have adjudication that something is a generic term, because that opens it up to being used and abused."
