    Panelists

    Thomas J. Cunningham is the leader of Locke Lord's Class Actions Practice Group and represents a number of the nation's top residential mortgage lenders and servicers in the defense of cases pursuant to numerous consumer protection statutes. Recently Tom has played a key role in litigation arising from alleged "Robo-signing" and foreclosure and bankruptcy irregularities. Tom also represents a number of clients in the MERS MDL proceeding. He regularly represents our mortgage industry clients in all types of litigation.
     
    Simon A. Fleischmann is the Leader of the Litigation Section of Locke Lord’s Consumer Finance Practice Group and has substantial experience in the representation of commercial lenders in loan workout and restructuring matters, including litigation matters concerning lender liability, duties under U.C.C. Article 9, and the rights of secured parties under the bankruptcy code. Mr. Fleischmann also has effectively handled cases involving disputes with respect to the reasonableness of valuation reports and fairness opinions.
     
    J. Matthew Goodin is a partner in the business litigation department of Locke Lord. Mr. Goodin’s practice focuses on complex civil litigation with an emphasis on consumer class actions. He represents banks, savings associations, mortgage banking companies, finance companies, and other financial institutions in state and federal courts throughout the country.
     
    P. Russell Perdew has represented mortgage loan originators, securitizers and other secondary market participants, and servicers in both individual and class action litigation. Mr. Perdew’s experience includes defending against alleged violations of the Truth in Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA), the Fair Credit Reporting Act (FCRA and FACTA), the Equal Credit Opportunity Act (ECOA), and various state unfair and deceptive trade practices acts, as well as claims for fraud, breach of fiduciary duty and breach of contract. Mr. Perdew also represents a number of clients in the MERS MDL litigation.
     
    Thomas G. Yoxall is a member of Locke Lord’s Executive Committee and concentrates his practice on financial services cases, class action litigation and general commercial litigation. Named a Texas Super Lawyer in 2005-2010, he has represented clients in nationwide and state class actions involving various types of claims, including mortgage lending practices, automobile dealer financing, consumer rebates, antitrust, products liability, breach of warranty, fraud, fair debt collection practices, and consumer protection.
