Locke Lord Prepares Petitions for Inter Partes Review Proceedings Challenging 5 EmeraChem Patents

A Locke Lord team, led by Steven Meyer, prepared petitions for inter partes review (“IPR”) proceedings challenging five EmeraChem patents relating to emissions control systems. The proceedings were then instituted by The United States Patent and Trademark Office’s Patent Trial and Appeal Board (“PTAB”) in March of 2015. On January 22, 2016, the PTAB held that nearly all of the claims of EmeraChem’s asserted patents were unpatentable. Locke Lord will continue to represent Volkswagen when the case returns to the District Court for the Eastern District of Tennessee for further proceedings on the patent claims that were not disputed in the IPR proceedings or survived those proceedings. Steven Meyer is representing Volkswagen in the District Court litigation.
