A Locke Lord team, led by Steven Meyer (New York), prepared petitions for inter partes review (“IPR”) proceedings challenging five EmeraChem patents relating to emissions control systems. The proceedings were then instituted by The United States Patent and Trademark Office’s Patent Trial and Appeal Board (“PTAB”) in March of 2015. On January 22, 2016, the PTAB held that nearly all of the claims of EmeraChem’s asserted patents were unpatentable. On February 22, 2016 EmeraChem filed a request for rehearing, which was denied by the PTAB on July 13, 2016.
