
Randall A. Hack is co-leader of Locke Lord LLP’s Antitrust Litigation Practice Group and more broadly engaged in the Firm's Business Litigation and Class Action practices. At both the trial and appellate levels, he represents corporate clients in significant antitrust, commercial litigation, contract, fraud, securities, RICO, intellectual property and other disputes. He also counsels clients on competition and other regulatory compliance issues.
Litigation: Mr. Hack has directed the defense of numerous civil antitrust price-fixing, tying, monopolization and Robinson-Patman Act cases. He has extensive experience opposing purported class or mass action claims. He has wide-ranging industry background, including financial services; health, property and casualty insurance; numerous manufactured products; health care; energy; technology; and, pharmaceuticals. He has worked extensively with economic experts addressing questions of market structure, conduct and performance.
Mr. Hack has a national practice and appears regularly in courts throughout the country. He is seasoned in handling hard cases with substantial financial exposure. He has served as chair or member of a number of national defense steering committees, where he has been responsible for directing and coordinating litigation across multiple forums. Counseling: In counseling work, Mr. Hack advises clients on how to anticipate and minimize large-scale litigation and regulatory risks in transactions and day-to-day business operations. Mr. Hack’s counseling work frequently involves clients with leading market positions who require guidance on their core business practices and strategies. He analyzes the antitrust and other regulatory risks of corporate transactions and joint ventures. He has experience before the Department of Justice, Federal Trade Commission and state Attorneys General resolving enforcement agency concerns. Along with advising corporate clients, Mr. Hack has counseled industry associations which have their unique set of governance, communication and other compliance issues. Mr. Hack also advises on antitrust compliance under European Union law and regulation.
Professional Activities: Mr. Hack has contributed to a number of American Bar Association treatises (including Antitrust Law Developments) and handbooks, led trial practice programs for ABA Subcommittees, and been a panelist on class actions, economic expert testimony, compliance, mediation and other issues at ABA and other professional conferences. For example, he contributed the chapter on internal corporate antitrust compliance reviews to Antitrust Compliance - Perspectives and Resources for Corporate Counselors, published in 2005. He has also been trained in mediation by the International Institute for Conflict Prevention and Resolution, a leading alternative dispute forum supported by many large firms and corporate clients throughout the world.
