Hot Developments with the Telephone Consumer Protection Act

This panel of regulators and attorneys from the defense and plaintiffs' bars will provide an overview of the Telephone Consumer Protection Act (TCPA) and describe pending FCC petitions seeking guidance on the applicability of the TCPA in various circumstances. And, because the TCPA also is a hot area for consumer class actions, the panel also will analyze significant TCPA decisions, settlements, and developments. Finally, the panel will review the FTC's Telemarketing Sales Rule (TSR) and Do-Not-Call (DNC) jurisdiction, touch on state analogues to the TSR, and explain the jurisdictional differences between the FTC and FCC with regard to robocalls and pre-recorded messages.
