
Kelly Turner is a member of the firm’s Litigation Department. For more than 17 years, Kelly has represented financial services, insurance and other clients in a wide variety of complex contract, business tort, general commercial, consumer fraud, class action and insurance disputes in state, federal and bankruptcy courts across the country.
Ms. Turner is Vice President and serves on the Board of Directors of the Coalition of Women’s Initiatives in Law, and she is Chair of the Coalition’s Membership and In-House Counsel Committees. Ms. Turner also is Co-President of the Auxiliary Board of the Oak Park River Forest Infant Welfare Society, which sponsors The Children’s Clinic located in Oak Park, and is the Director of one of the member “circles” of the OPRF Infant Welfare Society.
Business Litigation
Ms. Turner has handled almost all aspects of complex business litigation cases at the trial and appellate stage, representing clients both as plaintiffs and defendants in contract, business tort, consumer fraud, antitrust and class actions. Ms. Turner currently represents a personal lines insurer defending against several putative class actions brought in state courts in Illinois, asserting consumer fraud and other claims arising from bill review practices in connection with medical expense ("medpay") payments. Ms. Turner also recently defended mortgage loan servicers and a loan originator in individual and class action (single state and nationwide) cases seeking damages and other loan-related relief.
Ms. Turner represented a client in the payment card industry in large antitrust cases seeking substantial damages. Ms. Turner handled all aspect of those cases, including negotiating discovery issues with plaintiffs’ counsel, working with the client to locate responsive electronic and hard copy files, managing the collection and review of more than 3.5 million documents from the client’s files, and negotiating with and managing document collection and database vendors. In addition, Ms. Turner defended a client in consumer fraud-related class actions filed in New York and Pennsylvania, defeating class certification in two cases.
Insurance: Coverage & Litigation
Ms. Turner has represented domestic and London-based insurers in numerous state and federal court cases involving questions of primary and excess liability insurance coverage and seeking both declaratory judgments and damages. She has defended clients in cases involving environmental, products and professional liability claims. Ms. Turner has negotiated, including through mediation, settlement of many insurance coverage disputes, both those in litigation and before they reach litigation. Her insurance coverage experience includes appeals before state appellate courts, including Colorado and Ohio.
Bankruptcy & Restructuring
Ms. Turner also has practiced in the firm’s Bankruptcy & Restructuring practice area. She has represented creditors, including secured lenders and insurers, in bankruptcy courts in Delaware, Illinois, and Texas, among other states. Her experience includes representing an insurer client in a trial in bankruptcy court in Texas concerning the use and application of collateral (letter of credit, surety bonds, escrow deposits) and related contract disputes. In addition, Ms. Turner represented a client as plaintiff in an adversary proceeding against a debtor manufacturing company, seeking to recover in excess of $4.5 million with respect to certain manufacturing equipment, and she was instrumental in negotiating a quick and settlement of that matter for her client.
