Locke Lord’s multi-disciplinary team of attorneys has extensive experience in representing clients on transactional, regulatory and litigation matters involving online advertising, eCommerce and Internet law.
We have extensive experience in reviewing all types of advertising, including national television, radio and print campaigns for compliance with a complex web of federal and state consumer protection and right of publicity laws. In online advertising, specifically, we have experience relating to Internet search engine advertising, banner advertising and pop-up advertising, no matter where the source of the advertising originates around the world.
Our attorneys help foreign clients entering the U.S. market comply with all federal, state and local rules and regulations, including FTC and FDA guidelines, and consumer protection laws. We provide advice and guidance regarding market norms, which are often relied upon in private dispute resolution.
In the eCommerce area, we draft Terms and Conditions and Privacy statements for Web sites to comply with U.S. law. Our attorneys help clients design and implement effective electronic signature and electronic delivery processes for the sale of goods and services (including financial services products) on Web sites. Our experience also includes helping clients develop online payment processes.
We represent clients in the review of Internet Web sites for compliance with U.S. law. We advise on defamation and libel issues raised in the context of Internet Web sites, chat rooms and bulletin boards. Our experience includes working out solutions to commercial disputes through alternative dispute resolution (mediation and arbitration), zealous advocacy in jury trials and litigation, as well as specialty representations before private review bodies such as the National Advertising Division (NAD).
Our attorneys represent clients on compliance with the European Union privacy and data protection laws that may apply to Internet Web sites, outsourcing transactions and cross border data transfers.
We are also experienced in Internet domain name law. Our attorneys have successfully represented clients prosecuting and defending the ownership of domain names under the Internet Corporation for Assigned Names and Numbers’ (ICANN) Uniform Domain Name Policy before the World Intellectual Property Organization (WIPO), located in Geneva, Switzerland. We have been successful in representing clients in court actions under the U.S. Anti-Cybersquating Consumer Protection Act involving domain names. Our success, in particular, has been in representing clients in in rem actions under the U.S. Anti-Cybersquating Consumer Protection Act, where suit is brought against the domain name itself and the holder of the domain name is domiciled in a foreign country not subject to jurisdiction under U.S. law.
