Overview
Locke Lord works closely with health care industry clients to draft and lobby for the passage or amendment of legislation before state and federal legislative bodies. Our attorneys help clients with health care regulatory agencies on the interpretation and implementation of rule-making and coverage and benefit issues.
Our representative projects include:
- Assisting in introducing legislation that would allow a tax credit to individuals who donate up to $1,000.00 to a qualified patient assistance non-profit organization.
- Assisting in formulating a process to offer free pharmaceutical products to patients while counting towards a patients’ true out-of-pocket expense under Medicare Part D.
- Lobbying Congress on issues relating to health care coverage mandates, ERISA and HIPAA issues, and universal coverage.
- Working to ensure Medicare coverage of oral anti-cancer drugs in the Medicare Prescription Drug Improvement and Modernization Act of 2003.
- Lifting restrictions in certain states that allow consumers to purchase a long-term care insurance policy the benefits of which, once utilized, provided a dollar-for-dollar asset disregard for determining Medicaid eligibility.
- Working with Congress to provide greater public awareness that “Medicare does not cover certain long-term care needs” and that seniors should consider private plans. (prior to this, CMS did not communicate the message clearly that Medicare doesn’t cover some of the needs that seniors may need covered).
- Working to obtain appropriation funding for hospitals to be used for construction expansion and health care equipment.
- Assisting a statewide pharmacy in responding to an RFP involving contracted pharmacy services for HIV/AIDS patients.
