Overview
Locke Lord’s health care attorneys structure health care benefits and qualified plans and counsel on COBRA continuation, retirement and deferred compensation issues. Our representative experience includes:
- Representation of Texas government-owned hospital in resolving employee benefit compliance before the Internal Revenue Service.
- Structuring self-insured exclusive provider arrangements for facility provider’s employees.
- Representation of clients regarding development and plan design for plan documents and summary plan descriptions for self-insured and insured welfare benefit plans.
- Analyzing and drafting of contracts with and for third party administrators, pharmacy benefit managers, life and disability coverages, vision and hearing care providers and wellness benefit managers and providers.
- Advising benefit plan regulators, including State insurance departments, the Employee Benefits Security Administration of the U.S. Department of Labor and the Internal Revenue Service regulating cafeteria plans, flexible spending accounts and health saving accounts.
- Representation of plan sponsors and providers regarding data warehousing, HIPAA obligations and disclosures, security of plan information, breaches, data losses and thefts and notifications to plan participants.
- Extensive experience in managed care litigation and representing ERISA plans, plan administrators, and providers in a variety of disputes involving health, disability, accidental death and dismemberment, life and pension claims.
- Representation of ERISA third party administrators and excess loss carriers in lawsuits involving funding and coverage disputes, including administration of 401k programs.
- Assisting clients with the coordination of health benefits under ERISA and other group health programs, individual insurance arrangements, Medicare, Medicaid, CHAMPUS and worker’s compensation.
- Monitoring new legislation, regulations and court decisions affecting health benefit plans and regulated entities.
