
Cole Mackey practices in all areas of intellectual property law including litigation, prosecution, licensing, acquisitions, employment and confidentiality agreements, intellectual property portfolio management, enforcement, and counseling. He has experience in preparation and litigation at the district court and appellate levels of patents in the United States and abroad and rendition of opinions on non-infringement of patents in various arts. Mr. Mackey’s litigation experience includes litigation in many Federal Districts in Texas, as well as in State Court. His experience includes practice before the Trademark Trial and Appeal Board in trademark opposition and cancellation proceedings. Mr. Mackey has extensive experience in the transactional aspects of intellectual property law, including preparation and prosecution of U.S. and PCT patent applications, U.S. trademark and design patent applications, and European Community Design applications, as well as in trademark portfolio enforcement against infringement and counterfeiting.
Mr. Mackey also has experience assisting clients that have received demand letters regarding the patent licensing program of MPHJ Technology Investments, formerly of Project Paperless. MPHJ agents, including HarNol, AdzPro, DolVol, GosNel and JitNom, among others, focus on small to mid-size companies with the ability to scan a document into an email attachment. MPHJ’s patents include U.S. Pat. Application No. 13/182,857 and Pat. Nos. 7,986,426; 7,477,410; 6,771,381 and 6,185,590 for Distributed Computer Architecture and related processes.
Mr. Mackey also has significant experience in trade secret, copyright and related business litigation, including breach of contract, breach of fiduciary duty, unfair competition, and related claims. In addition, he provides a full range of services for Internet domain names, including litigation under the Anti-Cybersquatting Act, domain name arbitrations under the Uniform Domain-Name Dispute-Resolution Policy (UDRP), trademark clearance and disputes, and transactions involving domain names.
